Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards which could result in serious physical harm or death during a painting operation while working from a two point suspension scaffold which was supported from roof outrigger pipes and attached cables to the roof manhole were fabricated by company personnel and scaffold platform was altered without being approved by a duly constituted and recognized authority for its use (Section 3/28) ANSI as required by the American National Standards Institute for Safety requirements for scaffolding ANSI - H 10.8-1965: a) Jobsite: On or about 7/17/89, employees were exposed to fall hazards and serious physical harm or death while working from a two-point suspension scaffold which was supported by roof outrigger pipes attached to cable secured to the roof manhole which were not approved for safe use.
