Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees in the packing, stitching, making and lating departmnts performed tasks of the upper extremities and back and the employer had not evaluated the nature of engineering/ergonomic studies to identify effective methods of reducing these exposures, or administered a continuing effective program to minimize this stress. a) Packing Department - Empoyees were exposed to excessive ergonomic stresses resulting in serious disorders such as carpal tunnel syndrome, tendonitis, tenosynovitis, overuse syndrome and sprains and strains of the fingers, hands, wrists, arms shoulders and back. Factors contributing to excessive ergonomic stress included, but were not limited to, repetitive motions involved in the washing/ cleaning, repairing, spraying and pump form operations.
