Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to serious injury from the operation of an unsafe motor vehicle. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop and implement an effective daily vehicle inspection program to include all leased vehicles used during the blueberry harvest season: The program would identify safety and mechanical defects on vehicles. It would further require the vehicle owner, not the operator, to make repairs before the vehicle is put into service: E.O. Morse Blueberry Field-on or about 08/13/90, the leased Chevrolet 1971 C-60 truck, Maine reg. F47-515 was not maintained in safe condition. (Ref. Maine State Police report JC90-01566 dated 08/13/90).
