Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they are exposed to the hazard of entering railroad tank cars or hopper cars through 16 inch to 30 inch diameter hatch openings to do maintenance or repair work without a lifeline attached, at the Fitzgerald Railcar facility on or about 6/9/88. Among other methods, one feasible and acceptable abatement method to correct this hazard is: Provide a lifeline that is attached to wristlets or a body harness that must be worn by any employee who enters a confined space such as a railroad tank car or hopper car.
