Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
crushing injuries:
a) On or about June 29, 1988, employees were exposed to serious bodily
harm/death while attempting to extricate the International Harvester
706 Diesel tractor from an irrigation ditch in that: Employee(s) were
not trained in safe methods of extricating equipment which had become
stuck, including how to choose and use equipment of the appropriate
type, capacity and condition; employee(s) were not provided to
equipment of sufficient strength an in adequate condition to safely
remove a tractor of this size from the ditch.
Among others, feasible and acceptable abatement methods to correct these
hazards are:
1) Assure that employees receive adequate training to understand how to
choose tow equipment with sufficient working strength, how to examine
the tow equipment for abrasions or other signs of damage before use,
how to properly use the tow equipment such as avoiding shock loading
and abrasion sources, etc.
2) Assure that employees receive adequate training in proper handling/
storage of nylon rope, including protection of the rope from exposure
to moisture, sunlight, and sources of abrasion while in storage.
3) Assure that tow equipment provided is of sufficient strength to
safely perform towing operations required and assure that tow
equipment is properly stored and used.
