General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by flying metal pieces from rupturing pressure vessels/tanks: a) Plant, Compound Area: The employer altered the binks pressure vessels by welding shut the plug and gasket. A piece of metal was welded to the manifold. These modifications did not meet the American Society of Mechanical Engineers (ASME). Standard ASME certified welder was not used to make modifications. Altering the pressure vessel tanks could cause material stress fatigue in the metal, in turn would cause an explosion of the tank, on or about March 5, 1991. Abatement Note: Among other methods, one feasible and acceptable method of abatement to correct this hazard is to establish and enforce those procedures such as; that stipulated by the ASME boiler and pressure vessel code Section VIII, Div. 2, 1974; Part AF (Fabrication Requirements) AF 210.5 (Maintenance of Qualification and Production Records). Other essential elements for implementation of corrective measure include: 1) Before any alterations, a member of management shall be notified. 2) Before any alterations on certified tanks are made, consultation with manufacturer shall be conducted. 3) Provision for certifying individual welder and employees should be developed emboding instruction qualification with Section XI of ASME, Artifical F-2, AF 210.1. 4) Establishment of records which list a date upon repairs were made and purpose of repair and modification. 5) The finished weld-repaired surface shall be prepared and inspected by either a magnetic particle method in accordance with Article 9-1 or by a liquid penetrant method in accordance with Article 9-2. 6) The area repaired by welding shall be examined by radiography in accordance with Article I-5.
