Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries: a. In that employee(s) felling trees were not instructed to keep all other personnel out of the fall range of trees being felled; a contractor employee was permitted to work within the fall range of a tree being felled; and the tree was improperly cut in that the backcut was performed incorrectly, on or about March 31, 1993. Among other methods one feasible and acceptable method to correct this hazard is to train and enforce procedures to assure that personnel not involved in felling a tree are kept out of the fall range of the tree.
