Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries: a. While two employees were working from a make shift platform made by approximately 9 railroad ties in the grapple on the boom of the John Deere 790 D L-C Mobile Hydraulic excavator and lifted approximately 20 feet in the air to drill the side of the concrete silo on or about May 18-19, 1993. One feasible and acceptable abatement would be to erect scaffolding to access the working area.

One feasible and acceptable means of abatement would be to provide and enforce the use of safety belts, on or about May 25, 1993.
