Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard of undetected disease related to metal and dust exposure.
a) Employees angaged in blast furnace demolition at the CF & I site
were exposed to hazardous levels of lead, copper fume, iron oxide
fume, and inert particulates. No medical surveillance has been
offered to determine the physiological effedt of these exposures.
Affected employees include those cutting metal with torches as well
as those exposed to airborne fugitive dust from demolition related
activities.
Prolonged exposure to these substances can result in gastrointestinal
disturbancesm, nerve damage, anemia (lead), chronic upper respiratory
tract irritation (copper fume), chronic bronchitis, pneumoconiosis
(iron oxide fume) and mechanical damage to mucous membranes (dust).
A feasible and acceptable abatement method to control the hazard of
undetected occupationally related disease is to institute a medical
surveillance program to include pre-employment and periodic medical
examinations of all exposed employees. The medical examinations may
include:
a) Medical history;
b) Physical examination;
c) Pulmonary function evaluation;
d) Chest x-ray;
e) Blood lead/zinc protoporphyrin;
f) Urinalysis;
g) Complete blood count (CBC);
h) A written physician's opinion as to the state of the employee's
health and suitability for continued exposure.
The examining physician should be informed of the employees exposure
and use of personal protective equipment. If in the opinion of the
examining physician, an employee is, or is likely to be, adversely
affected by an occupational chemical exposure, steps should be taken
to protect that employee's health. These steps include, but are not
limited to:
a) Reevaluating the use of personal protective equipment.
b) Reducing the exposure through engineering controls.
c) Removing that employee from the source of exposure.
