Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard of oxygen deficient or toxic atmospheres from entry into and
welding in confined spaces.
a) Employees, on a non-routine basis, performed welding and other
activities in confined spaces (tanks) which were contaminated with
fertilizer and/or pesticides. The respirator which was used was not
NIOSH approved, employees did not use lifelines, nor was the standby
man present with suitable self-contained breathing apparatus.
Training and work procedures were inadequate.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to implement and enforce a confined space
procedure which includes:
1) Written procedures for work performed in dangerous atmospheres in
confined spaces including:
a) Rescue and training drills;
b) Procedures covering standby personnel with suitable rescue equipment;
c) Procedures covering the use of appropriate safety equipment such as
life line and body harness, hearing protection, or respirators;
d) Procedures covering the use of monitors to evaluate the confined
space for oxygen deficiency, toxics or combustibles.
2) Training procedures for work performed in confined spaces including:
a) All personnel working in confined spaces shall be trained and
informed about any hazards (fire, explosives, asphyxiation) they may
encounter use of safety and/or emergency equipment, work practices
and procedures;
b) Rescue standby worker(s) shall be trained in rescue techniques,
first-aid, and resuscitation;
3) Confined space work procedures including:
a) Continuous ventilation to maintain a safe, uncontaminated level shall
be provided during occupancy when a contaminant is being continuously
generated, or an approved air supplied breathing apparatus shall be
provided.
b) Personnel working in confined spaces shall be under observation or in
communication with a competent standby rescue worker(s) outside the
hazardous location;
c) Personnel working in confined spaces shall be provided with a rescue
harness, safety belt or wrist harness, and a proper life line;
d) Personnel working in confined spaces shall be provided with an air-
supplied respirator or a 5 minute, emergency escape, self-contained
breathing apparatus;
e) Respirators, either supplied-air or self-contained, shall be
immediately available for use by the rescue worker(s) and shall be in
a constant state or readiness.
4) Pre-entry procedures for confined spaces including:
a) A permit system for entry into confined spaces addressing:
-atmosphere for oxygen levels, combustible gases and vapors and toxics
likely to be encountered;
-location and description of the work to be performed;
-hazards that may be encountered;
-tagging, lockout, or isolation considerations;
-special clothing and equipment needs, including equipment to control
or counteract any adverse conditions;
-adequacy of personnel training;
-availability of standby person(s);
-provisions for periodic atmospheric monitoring or continuous
monitoring while work is being performed;
-date and expiration time of permit.
b) Specific entry, work, and/or rescue procedures that should be
followed;
c) Medical surveillance considerations;
d) Purging of atmosphere and verification of proficiency of ventilation
equipment;
e) Posting the confined space.
ABATEMENT NORMALLY WILL BE MULTI-STEP AS FOLLOWS:
STEP 1: Submit to the Area Director a written detailed plan of abatement
outlining a schedule for the implementation of engineering and/
or administrative measures to control employee exposures to
hazardous substances referenced in this citation. The plan shall
include, at a minimum, target dates for the following actions
which should be consistent with the dates required by this
citation:
a) Evaluation of the extent and location of the hazard source;
b) Evaluation of control measure options;
c) Selection of optimum control measures;
d) Determination of control measure design;
e) Ordering and delivery of equipment and materials;
f) Installation of control measures;
g) Training of employees in proper operation and maintenance of newly
implemented control measures; and
h) Assurance of effective performance of control measures.
All proposed control measures shall be evaluated for each particular
use by a competent Industrial Hygienist or other technically
qualified person.
STEP 2: Abatement shall have been completed by the implementation of
feasible engineering and/or administrative controls and upon
verification of their effectiveness of achieving compliance.
