Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
being crushed and/or struck by automotive lifts;
a) On or about 6-13-90 and at times prior to, employees were exposed
to serious bodily harm and/or death from being crushed and/or struck
by automotive hoists in that hoists had mechanical locking devices
that were not maintained in functional condition as they were stuck
in the closed position due to rust and/or debris. Further, foot pads
on the hoist arms were not maintained in good condition in that
attached holes were elongated allowing pads to collapses.
Additionally some hoists had leaks in the hydraulic system and had to
have as mush as five gallons per week added fluid.
One feasible method of abatement, among others, would be to establish,
implement and maintain a preventive maintenance and inspection program
as required by the manufacturer, the American Lift Institute,and the
American National Standards Institute (ANSI). Additionally foot pads and
defective seals in the hydraulic systems would have to be replaced.
