Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that they were exposed to the
hazards of fire and explosion associated with heating asphalt in
improperly maintained equipment in that the Cutler Heater was fired and
heated on "high" after engineering tests revealed the tubing containing
the asphalt was too thinned walled and had hairline cracks on or about
8/17/87.
Among other methods, some feasible and acceptable abatement method to
correct this hazard is:
1) Repair or replace any components which are below design specification
or which do not have a least a 4:1 safety factor for normal operating
conditions.
2) Do not operate equipment known to be unsafe.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that they were exposed to the
hazard of fire and explosion associated with improperly lighting a gas
oven in that gas valves were opened when there was not a reliable
ignition source and safety devices were bypassed on or about 8/13/87.
Among other methods, some feasible and acceptable abatement methods to
correct this hazard is:
1) Develop written operating procedures and train all operators in the
procedures for lighting off, firing and shutting down the oven. (See
NFPA 86A. Articles 100-5 and 550 for further clarification).
2) All safety devices shall be inspected, maintained, and not shorted
out or bypassed. (See NFPA 86A. Article 500 for further
clarification).
