Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about August 27, 1987, an employee was exposed to the hazard of being injured by a front end loader (no name, no number) should he have fallen off while riding in the bucket of the vehicle. Among other methods one feasible acceptale method to correct this hazard is strict enforcement of a policy prohibiting employees from riding on vehicles not equipped with proper seating.
