Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about January 22, 1988, an employee was exposed to hazard of being crushed by a Feiet Ellison FR15B front end loader transporting drainage pipe in that he was riding on the frame with his feet hanging out on the left side and no seat was provided for him. Among other methods, one feasible and acceptable method to correct this, is strict enforcement of a policy prohibiting passengers from riding on vehicles not equipped with proper seating (Reference ANSI B56.1-1969)
