Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
tree from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
death or serious burns as a result of improperly identifying the
condition of equipment and lines. Electric supply equipment and lines
which were not positively known to be de-energized were considered to be
de-energized:
a) North of turbine building, a work station was utilized under
energized high voltage lines in the immediate vicinity of live type
BW-900 oil filled transformers, on or about October 16, 1987.
One feasible and acceptable abatement method, among others, to correct
this hazard is to require that a person qualified by training and
experience make inspections or tests to determine the existing condition
of equiment and lines and have equipment and lines de-energized prior to
permitting employees into the vicinity of such equipment and lines.
