Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the following conditions which increase the risk of employees
contracting bloodborne diseases:
a) Hepatitis B vaccinations were not offered to all employees who are
involved in: 1) the performance of invasive procdures such as
vasectomies, tubal ligations and abortions; 2) the handling and
cleaning of sharp instruments which have been in contact with patient
blood; 3) the handling and laundering of clothing which has become
contaminated with patient blood; and 4) the analysis and disposal of
patient blood specimens.
b) The training described below was not provided to employees who are
exposed to patient blood during the performance of activities such as
vasectomies; tubal ligations; abortions; the handling of sharp
instruments which have been in contact with patient blood: the
collection, analysis and disposal of blood samples and the handling
and laundering of clothing which has become contaminated with patient
blood. The training must cover such matters as: 1) the modes of
transmission of the HBV (Hepatitis B Virus) and the HIV (Humand
Immunodeficiency Virus); 2) The universal precautions concept; 3) The
methods used to designate articles or refuse which have become
contaminated with patient blood or potentially infectious body fluids
4) The epidemiology of HBV and HIV; 5) Possible risks to a fetus;
6) The proper use of personal protective clothing and equipment;
7) The contents of CDC's "Update: Universal Precautions for
Prevention of Transmission of Human Immunodeficiency Virus, Hepatitis
B Virus, and other blood-borne pathogens in Health-Care Settings".
