Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following conditions which increase the risk of employees contracting blood-borne diseases: a) Hepatitis B vaccinations were not offered to all employees who are involved in: 1) the performance of invasive procedures such as abortions; and 2) the handling and disposal of fetal and patient blood and tissue. b) The training described below was not provided to employees who are involved in the performance of invasive procedures such as abortions and in the handling and disposal of fetal and patient blood and tissue. The training must cover such matters as: 1) the modes of transmission of the HBV (Hepatitis B Virus) and the HIV (Human Immunodeficiency Virus) 2) the universal precautions concept; 3) the methods used to designate articles or refuse which have become contaminated with patient blood or potentially infectious body fluids; 4) the epidemiology of HBV and HIV; 5) possible risks to a fetus; 6) the proper use of personal protective clothing and equipment; and 7) the contents of CDC's "Update: Universal Precautions for Prevention of Transmission of Human Immunodeficiency Virus, Hepatitis B Virus; and other blood-borne pathogens in Health-Care Settings".
