Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of falls likely to cause broken bones, paralysis, or death while working from the two (2) lower levels of a three (3) stage, two-point suspension scaffold without protection against falling in the event of scaffold suspension failure. The use of safety belts and lanyards was not enforced for two employees applying siding from the lower levels of the scaffold at approximately 20 feet above the lower roof level of the south plant.
