SECTION 5(A)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970: THE EMPLOYER DID NOT FURNISH EMPLOYMENT AND A PLACE OF EMPLOYMENT WHICH WERE FREE FROM RECOGNIZED HAZARDS THAT WERE CAUSING OR LIKELY TO CAUSE DEATH OR SERIOUS PHYSICAL HARM TO EMPLOYEES IN THAT EMPLOYEES WERE EXPOSED TO: EMPLOYEES WORKING IN THE REFUSE SORTING AREAS WERE REQUIRED TO SORT THROUGH PILES OF REFUSE THAT COULD POTENTIALLY CONTAIN CONTAMINATED NEEDLES AS INDICATED BY THE FACT THAT EMPLOYEES HAVE ON OCCASION IN THE PAST, EXPERIENCED PUNCTURE WOUNDS FROM NEEDLES PRESENT IN THE REFUSE. THESE EMPLOYEES WERE NOT TRAINED EXISTENCE AND PURPOSE OF THE POLICY PROHIBITING MEDICAL WASTE IN THE FACILITY, THE WAYS TO IDENTIFY MEDICAL WASTE AND ON WHAT ACTIONS TO BE TAKEN IF THIS TYPE OF WASTE IS DISCOVERED. FEASIBLE AND USEFUL ABATEMENT METHODS FOR REDUCING THE HAZARD, AMONG OTHERS, ARE: A) EMPLOYEE EXPOSURE TO POTENTIALLY CONTAMINATED NEEDLES CAN BE REDUCED BY PROVIDING TRAINING FOR EMPLOYEES ON THE EXISTENCE AND PURPOSE OF THE POLICY PROHIBITING MEDICAL WASTE IN THE FACILITY, ON THE WAYS TO INDENTIFY MEDICAL WASTE, AND ON WHAT ACTIONS ARE TO BE TAKEN IF THIS TYPE OF WASTE IS DISCOVERED. THE CONVEYOR LINE COULD BE STOPPED UNTIL IT IS CERTAIN THAT ALL MEDICAL WASTE PRESENT IN THE FACILITY IS PROPERLY DISPOSED OF; B) THE PILES OF REFUSE THAT PASS ALONG THE CONVEYOR LINE COULD BE REDUCED IN HEIGHT BY SPREADING IT OUT MORE, THEREBY REDUCING THE POSSIBILITY OF A PUNCTURE WOUND FROM A HIDDEN NEEDLE; C) POSTION AT LEAST ONE EMPLOYEE AT THE BEGINNING OF THE CONVEYOR LINE USING TELEFORCEPS OR ANOTHER TOOL TO INITIALLY SORT THROUGH THE REFUSE FOR MEDICAL WASTE AND TO SPREAD THE REFUSE OUT IN ORDER TO REDUCE THE CHANCES OF NEEDLES BEING HIDDEN FROM SIGHT ON THE CONVEYOR LINE.
