Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard of serious physical harm in that untrained employees were allowed to operate the bindery stitcher and folding machine. One feasible means of abatement, among others, would be to establish and supervise a program to educate and train all employees in the recognition, avoidance and prevention of unsafe conditions on the Bindery Room Stitcher and Folding machine. The training shall include but not be limited to, training of all employees on controls and functions following a checklist, maintenance of a training record, and an annual review of controls and unsafe conditions. Training shall ensure employees possess, demonstrate, and verbalize a working knowledge of machine controls, functions and prevention of unsafe conditions.
