Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to serious physical harm: a) On or about 12/09/88, employee(s) were exposed to serious physical harm while removing a sign from the side of a hotel. An employee was suspended in a botswains chair from a weathered and cracked wooden beam; Employee was exposed to a fall in excess of nine stories. One feasible method of abatement among others would be to use an I-Beam installed in accordance with established industry procedures.
