Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard of electric shock/electrocution in the event of contact with energized rolling stock on ungrounded railroad track between the railroad signal circuit. One feasible means of abatement among others would be the installation of an impedence bond on the ungrounded section of track.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard of broken bones or death in the event the train was derailed due to the broken rail at Mile Post 5 1/4 and 2 poles. Among other methods one feasible and acceptable abatement method to correct this hazard is to have the rail sections replaced with new rails.
