General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that : a) On or about November 16, 1988, and at times prior thereto, employees entering tank cars were exposed to the hazard of a lack of adequate rescue capability in the event of an emergency such as fire, explosion or employee incapacitation while: (a) Entering pressure tank cars including, but not limited to; anhydrous ammonia and LPG cars. (b) Entering general purpose tank cars including, but not limited to; diesel cars. Feasible and acceptable abatement methods to correct this hazard include: 1) Provide at least one man outside tank for each employee; 2) Provide a mechanical retrieval system for employees inside tanks; 3) Provide a body harness or other suitable rescue devices which will maintain proper positioning and enable easy passage of a disabled body through the hatchway.
