Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Where employee(s) were operating a freight elevator which was not provided with hoistway doors with combination hoistway door mechanical locks and electrical contacts or interlocks at the first, second, third, fourth, and basement landings, exposing employee(s) to the hazard of being injured or crushed by the freight elevator car. A feasible and useful method of correcting the hazard, among other methods, would be to install hoistway doors with combination hoistway door mechanical locks and electrical contacts or interlocks which would prevent the freight elevator car from moving when the hoistway door is not closed and would prevent the hoistway door from being opened when the freight elevator is not at the landing. b) Where employee(s) were operating and working near the freight elevator landing openings and the opening gate was not totally guarded to the full height of six feet at the first, second, third, fourth, and basement landings, exposing employee(s) to the hazard of falling into the hoistway enclosure. A feasible and useful method of correcting this hazard, among other methods, would be to install hoistway entrance openings with door or gates that are totally enclosed to the full height of six feet in height. c) Where employees were operating a freight elevator which was not provided with hoistway enclosures on all assessible sides on the first, second, third, fourth, and basement, landings, exposing employees to the hazards of being injured or crushed by the freight elevator car. A feasible and useful method of correcting the hazard, among other methods, would be to install hoistway enclosures extending from the landings to a height of not less than six feet above the landing. d) Where employees were operating a freight elevator which was not provided with a full top on the elevator car, exposing employees to the hazard of falling material from upper floors. A feasible and useful method of correcting this hazard, among other methods, would be to install a full top on the elevator enclosure. e) Where employee(s) were operating a freight elevator which was not provided with a car gate or door extending to a height of at least six feet nor with an electrical contact to prevent the car from being operated when the door is open, exposing employees to the hazard of being injured from the moving elevator. A feasible and useful method, among other methods, of correcting the hazard would be to install a gate or door with electrical contacts to prevent the car from moving while the door is open. f) Where employee(s) were operating a freight elevator which was not provided with a red emergency stop switch for employee(s) to use in case of an emergency, exposing them to potential injury. A feasible and useful method of correcting this hazard, among other methods, would be to install an emergency stop switch or button which is red or similar in color.
