Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed to high
airborne lead levels and potential lead poisoning without benefit of a
medical surveillance program:
a)  Kiwah Welding and Construction Co.
PSEG-West End Gas Plant
Duffield and St. Pauls Ave., Jersey City, NJ;
Employees who were required to torch cut lead contaminated metal surfaces
were not offered a medical surveillance program to assure that their lead
body burden did not result in lead toxicity or illness.
Violation observed on or about 12/20/91
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to institute a medical surveillance program which
includes:
(1)  Pre-employment physical and blood lead plus ZPP
(Zinc Protoporphyrin).
(2)  Monthly blood lead and ZPP level saampling.
(3)  Follow-up blood sampling tests (for elevated blood lead
conditions).
(4)  Voluntary Medical Removal Protection (for employees with
elevated blood leads).
(5)  Post-employment physicals.
(6)  Program administered by a physician who is aware of the nature
of the work and the use of respiratory protection.
AND IN THE ALTERNATIVE:
29 CFR 1910.134(b)(8):  Appropriate survillance of work area conditions
and degree of employee exposure or stress was not maintained:
Kiwah Welding and Construction Co.
PSEG-West End Gas Plant, Duffield and St. Pauls Ave., Jersey City, NJ;
a)  Employees who were required to perform torch cutting of lead
contaminated surfaces during plant dismantling were not part of a medical
surveillance program to insure that employee stress, as it relates to a
lead toxicity and lead body burden, did not exceed safe limits or results
in employees illness.
b)  Airborne lead exposure monitoring was not conducted for employees who
were required to torch cut lead contaminated metal surfaces during plant
dismantling.
