Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the underhung Robbins & Myers 5 ton pendant control crane, SN C 1595/
1597, located in the Boring Department was being utilized without
functioning bride and trolley brakes thus exposing employees to the
hazard of being struck by moving loads.
Among other methods, one feasible and acceptable abatement method to
eliminate this hazard is to correct apparent equipment deficiencies by
repairing the brakes and establishing a preventative maintenance program
as recommended by the crane manufacture and Section 11 of ANSI B30.11-
