Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) The hazard of being seriously injured or crushed in that, on or about
7-12-89 and at times prior thereto, employees were operating
equipment that were chained together in the excavation at LCF-N-1,
New Rayme, CO. The attachments welded to the equipment to support
the ends of the chain had not been certified by the manufacturer as
acceptable accessories on the equipment.
Among other methods, one feasible and acceptable method to abate the
hazard is: Have the equipment manufacturer equip and certify
accessories on the equipment; and discontinue work practices using
equipment as anchor points.
