Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees entering confined/enclosed spaces were exposed to the potential for an oxygen deficient atmosphere and/or and atmosphere containing hazardous amounts of air contaminants: a) Distillery area - Employees were permitted to enter fermenter tank number one for cleaning purposes, on or about April 9, 1986, without a determination that it was safe. One feasible and acceptable abatement method, among others to correct this hazard is to develop and enforce a confined/enclosed space entry procedure which would include the following: 1) Instructions as to the nature of the hazards involved and the necessary precautions to be taken in regards to confined/enclosed space entry. 2) Atmospheric testing to determine the presence of hazardous air contaminants and/or oxygen deficiency prior to entry and periodically during the occupancy of the confined/enclosed space or mechanical ventilation prior to entry and during occupancy of the confined/ enclosed space to insure that an adequate quanity of oxygen is supplied and that harmful contaminants are diluted to safe concentrations.
