Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to nurses and laboratory technicians at the clinic were exposed to the hazard of being infected by the Hepatitis B virus through possible direct contact with blood, blood products, or blood contaminated waste: Health care workers at Hope Medical Clinic for women were not offered Hepatitis B vaccinations free of charge in amounts and at times prescribed by standard medical practices as a part of a needle-stick management program to protect employees from the hazard of infectious blood-borne diseases such as but not necessarily limited to HBV. One feasible and useful abatement method, among others, is the offering of Hepatitis B vaccinations free of charge in amounts and at the times prescribed by standard medical practices.
