Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Blood and/or other body fluids which may contain the Hepatitis B Virus. Employees who came in contact with blood or other body fluids of the patients were not offered the Hepatitis B Vaccine. NOTE: Among other methods, one feasible and acceptable abatement methods to correct this hazard is to offer the Hepatitis B Vaccine to all employees who are or may be exposed to blood or other body fluids of patients. b) Blood and/or other body fluids which may contain the HIV or HB Virus. Employees working with patient's blood or other body fluids were not given training regarding the epidemiology, clinical presentation, modes of transmission and prevention of HBV and HIV as well as protective measures to be taken to prevent exposure. NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to train all employees who come in contact, or may come in contact, with blood or other body fluids regarding the epidemiology, clinical presentation, modes of transmission and prevention of HBV and HIV as well as protective measures to be taken to prevent exposure.
