Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazards of fire and/or explosion. Incompatible materials such as acetone were stored in the same detached outside storage building with organic peroxide formulations such as MEKP. Among other methods, one feasible and acceptable abatement method to correct this hazard is: To separate the flammable liquids from the MEKP by a wall having a fire resistance rating of at least one hour. Refer to NFPA 43B, (code for the Storage of Organic Peroxide Formulations), 1986 Edition, as stated in material safety data sheet for MEKP.
