Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
Employees were exposed to the hazards of crushing injuries and death
while being required and/or permitted to work under the loaded
concrete bucket (approximate weight 9 tons) while the bucket was
being lifted to and from the seventh floor of the building by the
hammerhead crane.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to cease operations in the crane area while
lifting and lowering of materials or equipment is taking place.
