Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
Employees were exposed to the hazards of crushing injuries and death
while being required and/or permitted to work under the loaded
concrete bucket (approximately 9 tons) while the bucket was being
lifted to and from the seventh floor of the building.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is rope off the area, restrict the area to necessary
personnel and assure all personnel in the area are in as safe a position
as possible and aware of the lifting or lowering taking place.
