Section 5(a)(1) of the Occpational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The employer failed to furnish his employees employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees in that the employer did not provide adequate training, instruction and supervision to employees who were assigned duties of operating power press brakes in order to ensure that correct safe operating procedures were being followed. There was no written policy defining safe practices, procedures, hazards nor was there any defined method of determining the degree of experience and competence of employee: The following examples are, but not limited to: a) In department 10, Cincinnati press brake machine No. 2009 using dies T-24107 to form roller channel parts 2903172-000/2903172-001; b) In department 10, Cincinnati press brake machine No. 2010 using dies T-23499 to form hand crank cover clip retainer parts 2079480-000; c) In department 10, Cincinnati press brake machine No. 2069 using dies T365 and K15449 to form chassis conveyor parts 2080400-B00.
