Section 5(a)(1) of the Occupational safety and health act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard of being struck by molten metal or debris due to the close proximity of water/moisture to the molten metal handling area at the direct arc melting furnaces. Material being charged into the furnaces was not preheated to assure that moisture not be introduced into the furnace plus the floor area near the furnace where the molten metal was carried over in the transfer ladles was not maintained in a dry condition. Feasible and acceptable abatement methods to correct these hazards include, but are not limited to: 1) Use of material preheating equipment such as a heating furnace or placing a heat source beneath or inside the charge bucket; 2) Preheating the material by placing the charge bucket containing the scrap near the top of the furnace until all moisture has evaporated; 3) Cleaning up the water on the floor and the maintaining of a dry condition in the area of the furnaces through close supervision; 4) Developing and enforcing a procedure that ensures that dry conditions are maintained when operating furnaces and handling molten metal.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard of fire and/or explosion created by operating the homemade gas heating barrel located in the testing area of the cleaning room which does not: assure the purging of residual gas prior ot an ignition source being introduced; assure the presence of a flame before allowing gas flow; assure that a reliable ignition source is provided; and assure that the gas flow is automatically shut off if any of the above should malfunction. Feasible and acceptable methods of correcting these hazards include but are not limited to: 1) Installing an automatic safety shut-off device, a flame detection device, a reliable ignition source and a controlled purging cycle; or 2) Replace the existing heating barrels and like equipment with approved heaters.
