Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about February 13, 1987, the Schwing KVM 28 Separate Placing Boom (serial No. 10065) was used to lift rebar into place on the 18th floor of the site. This practice is contrary to the manufacturer's specifications, and exposed employees to the hazard of being struck by falling objects. Among other methods, one feasible and acceptable method to correct this hazard, would be to prohibit use of the boom as a hoist as specified by the manufacturer.
