Section 5(a)(1) of the Occupational Safety and Health Act o 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about September 14, 1987, employees(s) were exposed to the hazard of electrical shock. Before work began, the employer did not ascertain before the employees started to work in close proximity to overhead energized electrical lines, in the green palm tree area of the nursery, that no person, tool, equipment or machine would make contact with the overhead energized electrical lines; and the employer did not instruct the employees in the recognition and avoidance of unsafe conditions applicable to working in close proximity to overhead energized electrical lines in a safe manner. Among other methods, one feasible and acceptable abatement method to correct this hazard is to instruct the employees in the recognition and avoidance of unsafe conditions applicable to working in close proximity to overhead energized lines in a safe manner.
