Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
The hazards of being struck by falling material when they were required
or permitted to pass and work under loads being moved (flown) and
suspended by a Manitowac 3900 Lift Crane:
Particular concerns include the hazards as follows:
a) An area used by employee(s) for lunch, meetings and breaks, (location
of the portable container for drinking water); was directly in the
path of the loads movement.
b) The stairs used by employee(s) for access to the ramps different
elevations was in the swing path of the load.
c) The walkways on the ramp were in the swing path of the load.
d) There were no safety ribbons on hazard warning signs specifying
"Danger" "Loads overhead", or "Danger" "Crane Overhead" to prohibit
employees(s) entry.
One feasible and acceptable abatement method among others to correct
this hazard is:
I) Coordinate work which requires use of the crane with other job
activities; to keep one area or direction clean of employee(s) for
use by the crane when swinging (flying) or suspending loads.
II) Install an audible alarm distinguishable from the surrounding
noises, that could be used by the crane operator to warn employees
when he is preparing to swing a load.
III) Require crane signalmen (flagman) to locate themselves so they can
be seen by the crane operator at all times. Also, require they be
located so they can visually see, at all times, the areas affected by
the swinging (flying) and suspended loads.
IV) Place barricades, safety ribbon and, or warning signs around areas
of crane activity to prevent employee(s) from entering where loads
are being moved or suspended overhead:
