Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) The employee's bin entry procedure was not adequate to protect
employees exposed to the potential hazards related to confined space
entry including potentially oxygen deficient or toxic atmospheres,
exposure to the rotating parts of the bin auger and bin sweep which
were not shut off and locked out, and being buried under grain. The
employer's bin entry procedure was inadequate in that:
1) There was no written bin entry procedure in use, with provisions for
training responsible employees.
2) There was no bin entry permit required.
3) There was no lock out requirement for mechanical and or electric
systems.
4) There was not atmospheric testing prior to bin entry and during
occupancy of the bin for sufficient levels of oxygen and absence of
toxic or combustible gases.
5) There was no tag out system to identify bins found to be unsafe for
entry.
6) There were no written emergency rescue procedures, and rescue
equipment such as safety harnesses and lifelines with provisions for
hoisting employees from the bin was not provided and used during bin
entry.
