Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
The hazard(s) of being struck by or caught in the closure action(s) of
the makeshift dumbwaiter located in the kitchen of the restaurant.
On August 2, 1989 and on prior occasions, employee(s) were allowed
to disable hoistway door interlock(s), stack food items atop the cab,
and to ride the dumbwaiter between floors, exposing them to the above
hazardous.
Among other methods, one feasible and acceptable abatement method to
correct this hazard would be to insure that an approved dumbwaiter is
installed meeting the requirements of the American National Standards
Institute A17.1 1987, specifically, Rule 700.8, Rule 700.11, Rule 702.1h
Rule 702.1, Rule 1000.1 and Rule 1010.4.
