Section 5(a)(1): of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from employees not being restrained in a forklift: a)Loading Dock South of Guahan Waste Recycle Warehouse: An employee was observed operating the Clark (Model#: CMP-25L; S/N: Defaced) without wearing a seat belt. ABATEMENT NOTE: AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO WEAR THE PROVIDED SEATBELT AS REFERENCED IN ITSDF B56.1-2005 "SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS" OR FOLLOW THE OPERATOR MANUAL UNDER USE OF SEATBELT.
