SECTION 5(A)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970: THE
EMPLOYER DID NOT FURNISH EMPLOYMENT AND A PLACE OF EMPLOYMENT WHICH WERE
FREE FROM RECOGNIZED HAZARDS THAT WERE CAUSING OR LIKELY TO CAUSE DEATH
OR SERIOUS PHYSICAL HARM TO EMPLOYEES IN THAT EMPLOYEES WERE EXPOSED TO:
RIG NO. 500 - THERE WAS NO EMERGENCY CONDITION INVOLVED AND
A FALL HAZARD, OF APPROXIMATELY ONE HUNDRED THIRTY-FIVE (135)
FEET ABOVE THE DRILL RIG FLOOR EXISTED WHEN AN EMPLOYEE WAS
PERMITTED TO RIDE THE TUGGER LINE OF RIG NO. 500.
ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD AMONG OTHERS TO CORRECT THE
HAZARD IS TO ASSURE EMPLOYEES RIDING THE TUGGER LINE SHALL WEAR A SAFETY
BELT WITH APPROPRIATE LANYARD AND SAFETY ATTACHMENT AND ADJUSTED TO
PREVENT A FALL OF MORE THAN FIVE (5) FEET SUCH AS SPECIFIED BY API RP54
FIRST EDITION JANUARY 1981, PAGE 11, SECTION 4.8 RIDING HOISTING
EQUIPMENT, PARAGRAPH 4.8.1 AND THAT A BOSUN'S CHAIR ATTACHED TO THE
TRAVELING BLOCK OR TUGGER LINE MAY BE USED TO REACH AN OTHERWISE
INACCESSIBLE LOCATION, PAGE 12, PARAGRAPH 4.8.4. THIS CONDITION OCCURRED
ON OR ABOUT JULY 5, 1990, APPROXIMATELY 7:45 P.M.
