The employer is not limited to the abatement methods suggested by OSHA; the methods explained are general and may not be effective in all cases; and the employer is responsible for selecting and carrying out an effective abatement method. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Rig Number 11: The employer failed to protect his employees from the re- cognized hazard of being struck by the shear pin on the shear relief valve, as the shear pin is expelled/sheared by the excessive pressure build-up. This employer could have pro- tected his employees by placing a cup over the shear relief valve or by other alternate means. This condition existed on January 16, 1991 on Rig Number 11 at the J.E. Thompson Well Number 10 Lucky Field, Matagorda County three (3) miles East of Bay City, Texas off Hwy. 60 Bay City, Texas 77414.
