Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
(a) A confined space entry program was not established to protect
employees who were exposed to hazards created by spaces with res-
tricted entry and exit, a primary function other than that of human
occupancy and that might contain potential hazards such as oxygen
deficiency, overexposure to toxic contaminants, and flammable atmos
phere. The american National Standards Institute Safety requirement
for confined spaces (ANS12 2117.1-1989) contains acceptable methods
of compliance which include the following:
1) Survey of all operations to identify confined spaces.
2) Hazard identification in each confined space.
3) Evaluation of hazards found by a qualified person.
4) Classifying the space as permit or non-permit required.
5) Development of a permit system for all entries that
authorizes work and appropriate protective measures.
6) Atmospheric testing prior to entry.
7) Attendants stationed outside the confined space in constant
communication with the occupants of the space.
8) Isolation of all energy sources within the space.
9) Ventilation of the confined space.
10) Proper personal protective equipment, such as respiratory
protection.
11) An emergency response plan for timely rescue.
12) Training of all personnel involved in confined space entry.
13) Periodic assessment of the program to ensure its continued
effectiveness.
