Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) The hazards of entry and work within confined spaces. Employees
are required to enter hydraulic fluid tanks in order to clean them.
Potential hazards include employee exposure to oxygen deficient
atmospheres, overexposure to air contaminants and burns from fire
from handling combustible liquids.
Among other methods one feasible and acceptable abatement method to
correct this hazard is to institute a confined space entry permit
program such as is described in the proposed OSHA regulation 29 CFR
1910.146 Permit Required Confined Spaces and which would address the
following areas:
1) Identify and evaluate each hazard of the confined space.
2) Established and implement the procedures to control these hazards.
3) Establish a written permit system.
4) Provide warning signs posted near confined spaces.
5) Preventing unauthorized entry by training or the use of barriers.
6) Training employees regarding the hazards of confined spaces.
7) Use of proper equipment for testing, communication, and personal
protective equipment.
8) Rescue procedures and equipment in place.
9) Protection of confined space entrant from pedestrian and vehicle
hazards.
10) Provide information to any other exposed employees' employer.
