Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to:
(a) The occupational health nurse at the first aid facility and
members of the emergency response team were exposed to the
hazard of being infected with HBV (hepatitis B virus) and HIV
(human immunodeficiency virus) through possible direct contact
with blood or other infectious body fluids during the treatment
of workplace injuries. Feasible and useful abatement methods
for reducing this hazard, among others, are:
(1) A Hepatitis B vaccination program shall be offered in the
amounts and at the frequency prescribed by standard medical
practice. The program should identify employees at sub-
stantial risk of directly contacting blood or other infect-
ious body fluids. Follow-up procedures after possible
exposure to HBV shall depend upon the immunization status
of the worker and the HBV serologic status of the source.
The CDC (Center for Disease Control) Morbidity and Mortal-
ity Report, June 7, 1985, may be consulted for recommenda-
tions on post-exposure prophylaxis.
(2) Follow-up procedures after possible exposure to HIV shall
include, HIV testing for the source. If the source consent
is refused or if the source tests positive, the health care
worker, including emergency response team members, shall be
evaluated clinically and the HIV antibody testing as soon as
possible and advised to report and seek medical evaluation
of any acute febrile illness that occurs within 12 weeks
after exposure. HIV seronegative workers shall be retested
6 weeks post-exposure and on a periodic basis thereafter
(12 weeks and 6 months after exposure).

(3)  Provide suffiecient training to those employees at risk of expo
sure to blood or other infectious body fluids when responding t
o workplace accidents/emergencies.  Training should address the
use of universal precautions for protection from contact with p
otentially infectious body fluids and the CDC recommendations r
egarding post-exposure prophylaxis and pre-exposure vaccination
