General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Jobsite - Employees required to engage in window cleaning activities, from two-point suspension scaffolding, were not provided adequate training in the safety requirements for the construction, operation, maintenance, and use of the scaffolding. Because of the lack of an adequate training program, unsafe conditions were observed such as: 1. two-point suspension scaffolding, supported solely by a 12" x 6" parapet, and not provided tiebacks, or any other secondary means of anchorage; 2. employees independent lifelines, supported solely by a 12" x 6" parapet, not securely attached to a substantial member of the structure; 3. scaffolding rigger positioned at the roof level exposed to a fall hazard of over 5 floors, and not provided a safety belt and lanyard, or other means of fall protection. One feasible means of abatement would be to assure that proper safe guarding and rigging methods for two-point suspension scaffolding adheres to 29 CFR 1910.28(g) - General Industry Standards, as well as the training requirements as specified in ANSI A39.1, Paragraph 3.3 - General Requirements for All Window Cleaning Operations.
