Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Being caught between the elevator floor and the wall opening structure or falling into the elevator pit due to the employer not providing doors or gates with interlocking devices on the freight elevator when being operated while any door or gate is open. Among other methods of abatement, one feasible means of correcting this condition is to install interlocking type gate guards. In accordance with rule 110.1 of ANSI A17.1-1987, Safety code for Elevators and Escalators. Such provisions prohibit the elevator from operating until the hoistway gates or doors are in the closeposition and such gates will not open until the elevator is at the same elevation (level).
