Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
to the hazards of:
2nd and 3rd degree burns from coming in contact with hot water and
concussions and/or lacerations from being struck by highly pressurized
hoses, because the hose in the gut room and another on the kill floor
floor were not equipped with constant pressure switches. The hoses
were used in the cleaning process at McCabe Packing Company.
Among other methods, one feasible and acceptable abatement method to
correct this hazard would be to install constant pressure switches on
all hoses used in the cleaning process with the following criteria:
1) The constant pressure switches should be maintained in a proper
operating condition and should be checked periodically to determine
if they are working properly.
2) Monitoring should be done by management to see that employees are not
bypassing the system.
3) Employees should also be trained in the hazards associated with high
pressure hoses and hot water.

a) The employer is not limited to the abatement methods suggested by
OSHA.
b) The methods explained are general and may not be effective in all
cases.
c) The employer is responsible for selecting and carrying out an
appropriate abatement method.
