Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment an a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) On February 9, 1990 the Electra-Bore employees working in tank #201
at Desoto Paint Company who were overcome by fumes and heat were not
protected from these hazards while working in this confined space
because the confined space entry program was deficient in that no
mechanical ventilation of tank nor adequate training of rescue man
was provided. One employee passed out the other became dizzy and both
ultimately were hospitalized at Dennison Medical Center.
Methods of abatement include but are not limited to:
1) Provide air horn or similar mechanical air ventilation system.
2) Train rescue man on use of SCBA's. Tankentry, use of proper rescue
